Who gets ownership of the unused footage of "An Inconvenient Truth"?

Does Laurie David own it? Or is it up to the judge to decide how much of the steamy footage that was left on the cutting room floor goes to Al and how much goes to Tipper? Whoever gets possession of it stands to make millions when they release the X-rated "Producer's Cut" on DVD.
